Recependo European directive 2015/1794, I decree allows to adapt the national ordering to that communitarian one in the field of the marine job, widening the system of the previewed protections to enforced ordering, with the objective to avoid that the marine workers can enjoy a different protect by the single Member States and that consequently he is not guaranteed, in the field, the parity of the conditions inside of the only market.
Finding that, if the contained discipline in the directive understood represents a meaningful advance of the protection of the marine workers at the level of the Countries of the Union, regarding Italy the necessary normative adaptation of the internal ordering is limited considered that the level of the guarantees for the worker is already particularly elevated based on the currently enforced norm, the government has specified that the main innovations that are introduced regard, substantially, the extension to the marine ones of the discipline in protection matter of the workers in case of insolvency of the employer, of European business committee, by right of information and consultation, extension of the involvement of authority of control in the procedures on the lay-offs collectives, of transfer of enterprise, so as to increase the level of protection of the sanctioned rights from the Paper of the fundamental rights of the European Union and to assure homogenous conditions of competition in the home market.
The text has obtained the favorable opinions of the special Commission of the Chamber of Deputies and the Senate of the Republic, let alone of the permanent Conference for the relationships between the State, the E regions the independent Provinces of Trento and Bolzano.
