Les premières discussions ont lieu à l'heure où ces lignes sont écrites. Nous avons fait état du point de vue des différentes parties dans nos précédentes éditions, mais apparemment, tout le monde n'est pas d'accord.
  • La loi belge sur le travail portuaire n'est pas contraire à la réglementation européenne
    La législation belge sur le travail portuaire, qui stipule que le traitement des marchandises dans les zones portuaires ne peut être effectué que par les travailleurs portuaires reconnus, n'est pas contraire à la législation européenne de libre concurrence. C'est la conclusion de l'avocat-général Ruiz-Jarabo Colomer de la Cour européenne de Justice, qui s'est penché sur une question préjudicielle du tribunal d'appel de Gand. S'il s'est uniquement prononcé sur l'application de la loi dans le port de Gand, sa conclusion vaut également pour les autres ports maritimes flamands. L'avocat-général espagnol estime en outre que d'un point de vue juridique, la situation à Gand ne peut être assimilée au précédent à Gênes, qui a donné lieu à la condamnation de la législation italienne en la matière. La Cour européenne de Justice doit encore formuler un avis définitif, mais l'avis de l'avocat-général est généralement suivi.

    "Notre but est de continuer nos activités seuls. Nous n'avons pas de projets de fusion, d'acquisition et encore moins de vente." C'est ce que nous a déclaré Mercelo Ramos, représentant de l'armement Compañia Chilena de Navegación Interoceánia (CCNI), lors de la réunion organisée à Anvers mercredi dernier à l'initiative de la Chambre de Commerce belgo-luxembourgeoise-chilienne(1). A un moment où le secteur du liner sud-américain fait l'objet d'importantes rationalisations sous forme de reprises ou de joint-ventures, le point de vue de ce représentant de CCNI est intéressant.
  • ETA: une assemblée pour rien?
    L'European Tugowners Association (ETA), qui tenait ces jours-ci son assemblée à Anvers, a clôturé ses travaux sans qu'aucune résolution particulière n'ait été avancée, alors qu'on était en droit d'attendre un appel pressant à l'endroit de l'Union européenne pour que celle-ci instaure un contrôle du marché européen du remorquage, impliquant des règles précises sur le plan de la sécurité et des techniques. Manifestement, il y a eu un manque d'intérêt.
