Outre plusieurs adaptations, deux soucis fondamentaux continuent à retenir leur attention: la définition trop étroite de la concurrence pertinente pour le secteur de la manutention et le fait que la directive semble uniquement concerner les ports appliquant le ‘modèle landlord’ (attribuer des terrains à des opérateurs privés).

  • UE: la directive portuaire adoptée avant la fin 2002?
    A l’issue de leur rencontre au sommet à Barcelone, les chefs d’Etat et de gouvernement européens ont lancé un appel aux ministres européens du Transport, leur demandant d’approuver les propositions formulées par la Commission européenne en matière des services portuaires avant fin décembre. Le Premier ministre belge Guy Verhofstadt a en vain tenté de faire rayer cette date du texte de la déclaration finale. Si la directive européenne est approuvée, le chargement et déchargement des navires devra par exemple être libéralisé, et cela vaut également pour les services de pilotage et de remorquage. Selon certaines sources, la nouvelle législation entrainerait la suppression de la loi Major et les ouvriers portuaires anversois prépareraient déjà des actions. L’ouverture de ce marché à la concurrence ne signifie pourtant pas automatiquement la disparition de cette législation.
