L'evidente intento di Assomarinas, con il suo ricorso contro Assomarina, è di rilevare una linea di demarcazione tra attività e prerogative della parte pubblica e di quella privata al fine di evitare che la prima possa instaurare forme di monopolio più o meno manifeste accordando concessioni del demanio marittimo a favore di enti pubblici.
Non sempre le attività economiche soffrono della sopraffazione della parte pubblica su quella privata o, come accade altrettanto spesso, della prevaricazione della parte privata su quella pubblica. Sovente, invece, è proprio la commistione di interessi privati e pubblici ad intorbidire i rapporti di forza economici.
È difficile stabilire quando il sostegno pubblico all'iniziativa privata supera la linea di confine tra la semplice promozione delle attività economiche e si trasforma in garanzie che la parte pubblica concede ad alcuni privati a danno di altri. Forme di impulso pubblico all'iniziativa privata sono ovviamente presenti anche nella portualità turistica, come ad esempio quella recentemente realizzata da Italia Navigando, società che fa capo all'agenzia governativa per lo sviluppo d'impresa Invitalia, con l'accordo stretto con il gruppo privato MAST della Spezia per lo sviluppo di una rete nazionale di porti turistici ( del 10 maggio 2011).
Al fine di evitare che tale questione sia affrontata esclusivamente in sede giudiziaria, appare necessario che lo Stato e le sue società si dotino di norme e procedure più rigorose che assicurino piena trasparenza ed imparzialità.
Lo sviluppo delle attività economiche è già difficoltoso senza l'indebito intervento della mano pubblica e diventa estremamente più complicato quando la parte pubblica assume il ruolo di concorrente o di partner delle imprese.
