Agreement between Parliament, Council and EU commission on the regulations that Guard Costiera institutes and of European Frontier



The Parliament, the Council and the Commission of the European Union have reached an agreement, that it is approved of in the today's reunion from the European Council, on the proposal of the Commission for the institution of Guard Costiera and of European Frontier (European Border and Coast Guard - EBCG) realized arranging the forces of a new Agency, through the potenziamento of Frontex, the European Agency for the management of the international cooperation to the external frontiers of the Member States of the EU, and a pool of means and staff.

In particular, the agreement reached from the three institutional organisms of the EU only previews that the Agency has a greater role in bringing back the migrants in their country of origin, but as a result of the execution of decisions already adopted by the national authorities, dispositions on the repatriations that ulteriorly are strengthened by ulterior guarantees on the fundamental rights, while the Agency will not be involved in the repatriations between the nations not EU.

The understanding previews that if a Member States is opposed to a decision to supply assistance assumed from the Council, the other Eu country can temporary introduce the controls to the internal frontiers.

The agreement previews moreover that the teams of the frontier guards who will take part of a pool of fast participation will be dotal of average the necessary equipment creating a park of fast reaction that will have to be available within and not beyond 10 days after the operations plan of participation is agreed.

It is decided also, in order to guarantee a greater cooperation between the Agency and the Member States, the institution of civil employees of connection whom charged to monitor all the Member States of the EU with external frontiers and that every civil employee can cover until four geographically near States.

At last the agreement previews that the European Parliament is held informed through periodic relations and guaranteeing to eurodeputati the access to the information. Also the role of the Parliament is strengthened relatively to the procedure of selection of the executive director of the Agency.

Next monday the agreement will be subordinate to the ballot of the Commission for the civil Freedoms, justice and internal transactions of the Parliament EU and, if approved of, will be voted the next month from the Parliament in the course of the plenary session to Strasbourg.

"The agreement on the creation of Guard Costiera and European Frontier - it has emphasized the president of the EU commission, Jean-Claude Juncker - demonstrates that Europe is able to act quickly and with decision in order to face common challenges This is an initiative of which for a long time the requirement was felt. The Commission had evidenced it in May 2014 and I have emphasized it during my election campaign: we need to strengthen Frontex in meaningful way and to transform it in a system of Guard Costiera and totally operating European Frontier. From when we have introduced the proposal last December - it has added Juncker - the Commission has worked in constructive way with our partner in the European Parliament and the Council and would want to thank in particular the Dutch presidency, the my first vice president Frans Timmermans and the commissioner to the Dimitris Avramopoulos Migration for the their untiring job on this important project that it will today demonstrate to the world that from Europe draft the protection of its frontiers as a common mission of solidarity".

"We have reached this compromise with the Dutch presidency - the head has said negotiator of the Parliament on the regulations, Artis Pabriks - in the short time. With this regulations we have returned the Agency for Guard Costiera and of more effective European Frontier, more efficient and more responsible. "We have instituted an Agency - it has specified Pabriks - with greater powers and responsibility, that it will be able to supply assistance to any Member States that is found to face exceptional migratory pressures or any other problematic one to the external frontiers. There will be - it has specified - the minimal pool of 1.500 guards of the frontier and a pool of technical equipments available so that they can be employed from the Agency anytime. And if a Member States refuses to collaborate with the Agency in a measure that endangers the operation of Schengen, the other Member States will have the possibility to temporary introduce the controls to the frontiers through article 29 of the code Schengen frontiers, that light it is amended with this regulations".

"The regulations for Guard Costiera and of European Frontier - it has concluded Pabriks - will assure that the external frontiers of the EU surer and better are managed. This is not a magical prescription that can resolve the migratory crisis that today the EU finds to face or that it can totally restore the confidence in the Schengen zone, but constitutes a first absolutely necessary step".
