Brussels submits Italy to the Law court EU for the lacked recovery aids granted to Sardinian societies of navigation
the decision of the EU commission goes back to July 2007
October 19, 2011
The EU commission has submitted Italy to the Law court of the EU for the lacked recovery aids granted from the Sardinia Region to society of navigation with registered office, fiscal address and disposed port of registration in Sardinia to construct, to acquire, to reconvert or to repair ships, that is for the lacked ottemperanza to a decision of the Commission of the 2007 that declared the regime of aids in favor of the Sardinian enterprises of incompatible navigation with the norms of the EU in matter of aids of State.
Such regime of aids, whose institution goes back to a regional law of 1951, consisted in loans to interest rates reduced in average of the 10-12% and a subsidy for the costs of a lease financial institution with a medium abatement of interests of 10% to the Sardinian enterprises of navigation engaged in activity of construction, purchase, conversion or repair of naval units.
In October 1997 the EU commission had adopted a first decision in matter of aids of State on the regime in favor of the Sardinian societies of navigation. In October 2000 such decision was cancelled by the Law court that had judged insufficient the tests of the incidence of the measure on the exchanges between Member States. In July the 2007 Commission had newly adopted the decision with a strengthened motivation and such decision is not contested.
Brussels has explained that, not having notified the advances granted from the Sardinia Region to preferential conditions, Italy was held to recover the difference between the rates practiced on such advances and the rates market in vigor to the date in which these they were granted and that to four years from on July 10, 2007, date in which the Commission it had ordered the recovery of the aids, this still has not happened.
"The Member States - the vice president of the EU commission and commissioner has declared for competition, Joaquín Almunia - have numerous possibilities to support the business activities in the respect of the norms of the EU in matter of aids of State. However, the judged aids illegal must be recovered quickly in order to restore fair conditions and to preserve the effectiveness of the same norms".
