Dans cette éventualité, les propositions de la Commission tendent à entériner l'état de fait actuel, à savoir une responsabilité quasi-exclusive des affréteurs. Elle semble exclure d'emblée toute responsabilité financière réelle des armateurs." Les chargeurs européens formulent dès lors certaines contre-propositions.
