the EU commission newly rejects the sector prohibition of Tirol for the trucks that cover the A12 freeway



The EU commission has newly expressed reserves on the previewed adoption by the authorities Austrians of a prohibition of circulation for the trucks that cover a feature of the A12 freeway that runs in the valley of the Inn, in Tirol, artery that is one of the main aces of communication between Italy and Germany. The prohibition, introduced with the objective to reduce the pollution, was adopted in 2003. In the 2005 Law court of the European Union it had established that such prohibition was incompatible with the principle of the free circulation of the goods being disproportionate regarding the scope of protecting the quality of the air. Austria had adopted therefore new measures which the imposition of a limit of speed on the highway feature and the prohibition of circulation for the trucks pertaining to determined classes Euro and, successively, newly was adopted, as in 2003, a prohibition of circulation for the trucks with fully loaded advanced mass to 7,5 tons that transport determined types of goods. In the 2011 Law court of the EU it had newly established that these measures constituted a restriction to free the circulations of the goods whose transport was prohibited on the highway feature and, in particular, than Austria it had adopted a sector prohibition of circulation without to have sufficiently examined the possibility to make resorted to other less restrictive measures.

Currently, on the base of provisions of the Land of Tirol, some restrictions to the truck transit are taxes on the A12 freeway between Kufstein (kilometer 6) and Zirl (kilometer 90), included a prohibition of transport of some goods on vehicles of beyond 7,5 tons in vigor from night May 2008, let alone no thoroughfares, of overtaking and limitations of the speed. The Land has but in program the reintroduzione of the sector prohibition of transit implementing it in two phases: the first, with performance from the next 1° July, relatively to the heavy means that transport refusals, stony and terrosi materials, material of digging, you cut, cork and motor vehicles; the second one, with performance from next 1° the October, relatively to the heavy means that transport iron ores and not, steel (except armors and constructions), marble, travertine, floor tiles of ceramics. At the end of 2015 Austria it has notified these new dispositions to the EU commission

This last one has newly suggested to Austria measures alternatives in order to promote a reduction of the traffic with the scope to improve the quality of the air without to hinder, with a sector prohibition, the free exchange of the goods. Between these, the differentiation of the toll of the heavy traffic according to the class Euro of the vehicles and an ulterior reduction of the speed of 80 the light vehicles to km/h.

Proposals that the regional committee of Tirol has decidedly rejected: "the limit of 80 kilometers per hour for the cars on our roads - Günther Platter has sentenziato - is absolutely outside issue

The confirmation of the perplexities of the EU commission on the last measures introduced from Austria is received with favor from the Italian association of the road haulage enterprises goods and logistics ANITA: draft - it has emphasized the president of the association, Thomas Baumgartner - of "an important passage that it receives our thesis that the prohibition so as formulated it damages the free exchange of the goods on a strategic axis for the connections between Italy and the remainder of Europe, without an appreciable effect on the reduction of the environmental impact".

ANITA has moreover expressed appreciation also because the EU commission convene on the necessity to prohibit the circulation to the more obsolete vehicles, inferior but numerically responsible in greater measure of the produced pollution, also in order to accelerate the substitution of the vehicles by the professional user and of the private traffic: "the advance of the tempistiche of permanent prohibition for vehicles Euro3, than the Commission already it wishes can leave from the half of 2016 - it has found Baumgartner - he is totally condivisibile and it goes in the auspicious direction in order to reduce the environmental impact of the street transport and to increase the quota true rail shipment, but - it has specified - destiny in Tirol must be worth for vehicles in egual measure in transit and for those with origin/".
