the Italian Regions ask the activation for the cabin of direction in performance of the norms of reorder of the Harbour Authorities



The Conference of the Regions has asked the Ministry of Infrastructures and of the Transports to institute in times breviums the combined technical table with the Regions which cabin of direction in performance of I reorder of the Harbour Authorities. With an approved of document on 29 September, that we publish below and that on March 31, 2016 includes in attached also a precedence document, the Conference of the Regions has turned such exhortation to the ministry having evidenced as such initiative allows to reach to a solution shared of the problematic ones excluded from decrees legislative on the reorganization, rationalization and simplification of the concerning discipline the Harbour Authorities, normative that has taken effect with the publication on the "Gazette" 31st August, and - they have specified the Italian Regions - the monitoring of the implementing phase affords of decrees same.

The Conference of the Regions has remembered that such norms among other things preview that for a not advanced transient period to 36 months the Regions interested can demand the administrative autonomy of or more inserted ports, from decree legislative same, in determined Authority of Harbour System (AdSP). Moreover, I decree legislative previews the possibility for the Regions to subject, if they will consider it necessary, proposals of modification is to the composition of the Authorities of Harbour System with the insertion of ports of regional interest within AdSP of own territory is to the passage of a port from a AdSP to a territorial not contiguous other also.

To such purpose the Conference of the Regions has remembered moreover that various Regions - Campania, Liguria, Sardinia and Sicily - have formalized demanded to maintain the autonomy transitory of some ports, than the Tuscany Region has approved of the proposal to let in a regional port in the Authority of Harbour System of the Tyrrhenian Sea Northern and that the Abruzzi Region has already formalized the proposal to transfer own ports of Pescara and Ortona in the Authority of Harbour System of the Tyrrhenian Sea Central and it is in phase of formalizzazione the demand by the Region Latium.

Besides the institution in times breviums of the technical table combined with the Regions which Cabin of Direction, the Regions have asked the Ministry also the predisposition, in fast times, of the outline of regulations necessary to so put into effect the codicil 2-second of art. the 6 of law 84/1994 as modified from article 7 of I decree legislative 124/2015 and of the outline of I Prime Minister's decree face regulating the previewed transitory phase from codicil 2 of article 22 of the same one I decree legislative.
