Agreement between Harbour Authority and CIPNES in order to place end to the litigation on state property areas in the port of Olbia



The Authority of Harbour System of the Sea of Sardinia has announced to have undersigned with the Industrial Consortium Provinciale East Nord Sardinia (CIPNES) a transaction action that places officially fine, concluding a iter legal along 11 years, to the litigation on the state property markings out between CIPNES and the former Harbour Authority of Olbia and Golfo Aranci and that it establishes the start of a new shared state property marking out.

Object of competing for, the established marine state property limits in Porto Cocciani (Olbia) in April of the 2005 that excluded from the possession of the Industrial Consortium the manufactured ones and some destined areas to large squares of the olbiese industrial port of call, successively placed under seizure in 2006 and entrusted in judicial guard to the Harbour Authority.

The AdSP has specified that the agreement, which reached at a distance of beyond ten years and with a still hanging sentence the Civil court of Cagliari, previews the withdrawal of the causes, the renunciation to any risarcitoria action and, above all, the start of a new state property marking out and, therefore, to the division of the mutual competences on pieces of real estate and spaces harbour. Process, this last one, than, on the base of the transaction, will continue with the passage to the table of the commission - composed from Harbour office, Provveditorato to the Public works and Agency of the Federal property - for the new marking out.

"The definition of the transaction action - it has emphasized the president of the AdSP of the Sea of Sardinia, Massimo Deiana - places end to a long and onerous litigation for the two agencies. We have considered, of common agreement, to reach to a fair conclusion and of good sense for the parts and, above all, to place end to ulterior expenses lawyers and extraordinary workloads for the structure. They are sure that, in the next passage to this agreement, the which charged commission to establish the new marking out will wisely know to reach to a redefinition of the mutual competences on the port, in way such to at best value the activity of every agency".

Deiana has specified that with the CIPNES will not be first and only action face to exceed situations of administrative stall: "this agreement - it has explained - is the pacer for the solution of the other litigations in being with the Cacip and the Industrial Consortium of Oristano. It is our understanding to resolve them all with good sense and reasonableness, avoiding, in future, to engage the agency in long, onerous procedures and from the uncertain outcomes, holding always firm the main objective of giving to the entire system of the Sardinian ports greater serenity and operating certainties".
