GABON - NEW SHIPPERS' COUNCIL FEES BASED ON OCEAN FREIGHTS

Further to the previous notice on this subject, BIMCO has now received clarification from the Gabonese Shippers' Council on the new fees which will soon come into force. It was established that:
The new proposal aimed at taxing the gross freight will only apply to oil and manganese shipments, not against all ocean freights as previously advised.
The rate to be applied against oil and manganese cargoes is 8% of gross freight. For other types of cargoes, the fees will continue to be assessed based on the cargo quantity at the following rates:
Administrative Commission:
- Import
FRF 6.00 per ton or cbm
- Export
FRF 4.00 per ton or cbm
- Transit/Transhipment
Exempted.
Commission on Trade Rights:
- For coastal service
USD 4.00 per ton or cbm
- For other routes
USD 6.00 per ton or cbm
The commission on Trade Rights will be calculated on 40% of the whole cargo on board, except for cargo in transit/transhipment.
Collection of the fees related to oil and manganese cargoes is set to begin on 1 April 1997. However, the Shippers' Council has stated that shipowners and operators which have not traded to Gabon since 1 June 1995 may apply to have the fees waived. Such applications should be made to Trading and Shipping S.A., as described below.
Ship owners and operators must inform the Shippers' Council of vessels' fixed for Gabonese ports to load or discharge oil and manganese cargoes at the same time that port agents are divided. This information is to be submitted to Trading and Shipping S.A., Gabonese Shippers' Council, (Phone +241 76 32 95, 76 20 88, 72 36 50; fax +241 74 66 55; Telex 5316 GO). Requests for additional information and guidance concerning the fees may also be submitted to Trading and Shipping.
The fee are to be collected by the port agents.
The fee is officially referred to as the 'Gabonese Traffic Rights Tax'.
